01Eligibility

Aestie is not directed to children. Minimum age: 13 in the US and 16 in the EU/UK (or higher where local law requires).

• We do not knowingly allow children under these ages to use Aestie, and we will delete data we learn was collected from them.
• If you use Aestie on behalf of someone else, you confirm that you are authorized to do so.

02What Aestie does

Aestie provides two main features:

• Filters & Effects — aesthetic filters and effects that you can apply to your photos.
• Aestie Match — lets you provide a reference photo you love and your own photo. Aestie uses the reference to recreate its visual aesthetic — including colors, lighting, mood, grain, and overall look — on your photo.

• Aestie Match uses artificial intelligence to process your selected photos and create the requested result.
• AI-generated or AI-assisted results may not be identical to the reference photo and may sometimes produce unexpected or inaccurate results.

03Your content & permissions

• You own the photos you upload.
• As between you and us, you are free to use the images you create with Aestie. However, the legal status of AI-generated outputs varies by country and such outputs may not be protectable by copyright. We do not guarantee that an output is free from third-party rights.
• You grant us a limited, revocable license to process your photos only as necessary to operate Aestie and provide the features you request, including processing photos through Aestie Match.
• You must have the rights and permissions necessary to use every image you upload.
• If another person appears in a photo, you are responsible for having any consent required to use and process that photo.

04Acceptable use

You agree not to:

• Bypass technical limits, rate limits, subscription limits, or other usage restrictions.
• Attempt to gain unauthorized access to Aestie or its systems.
• Probe, scan, or test system vulnerabilities.
• Interfere with, disrupt, or overload Aestie or our service providers.
• Reverse-engineer or attempt to extract source code, models, prompts, or other proprietary technology.
• Use Aestie for unlawful, defamatory, fraudulent, abusive, or infringing purposes.
• Create non-consensual deepfakes or deceptive impersonations.
• Use Aestie to violate another person’s privacy or publicity rights.
• Attempt to circumvent security or abuse-prevention measures.
• Use automated systems to abuse, scrape, or excessively access Aestie.

We may monitor for abuse and suspend or terminate access for violations of these Terms.

05Subscriptions & billing (Apple IAP)

Aestie may offer paid subscriptions and other paid features through the Apple App Store.

• Subscription prices, billing periods, available plans, and any introductory offers are displayed in the Aestie app and Apple App Store before you purchase.
• Prices may vary by region and currency. Apple displays the exact price applicable to you before purchase.

• We may change subscription prices for future billing periods. Where required, Apple will notify you of applicable price changes before renewal.
• Taxes may apply depending on your location.

06Subscription access & usage limits

• Some Aestie features may be limited based on your subscription plan or usage allowance.
• We may use Apple’s transaction information and our subscription-management systems to verify your active subscription and provide the features associated with your plan.
• We may also use anonymous identifiers and technical information to prevent abuse and enforce usage limits.
• We may change, suspend, or discontinue particular features or usage limits at any time, subject to applicable law.

07Third-party services

Aestie relies on third-party services to provide certain functionality. These may include:

• Apple (App Store / StoreKit) — for purchases, subscriptions, and billing.
• AI processing providers — to process photos submitted to Aestie Match and generate requested results.
• Subscription-management providers — to manage subscription status and entitlements.
• Analytics and crash-reporting providers — to understand product usage and diagnose technical problems.

• Each third-party service may have its own terms and privacy practices.
• We are not responsible for the independent practices or availability of third-party services.

08Apple-specific terms

• These Terms are between you and us, not Apple.
• Apple is not responsible for Aestie or its content.
• Apple has no obligation to provide maintenance or support services for Aestie.
• If Aestie fails to conform to any applicable warranty, you may notify Apple and Apple may refund the applicable purchase price, if any, in accordance with Apple’s policies.
• You must comply with Apple’s applicable usage rules and terms.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you where applicable.

09Intellectual property

We (or our licensors) own Aestie, including its software, design, branding, logos, interface, technology, and other proprietary materials.

You receive a limited, personal, non-transferable license to use Aestie on Apple devices that you own or control, subject to these Terms and Apple’s rules.

You may not:

• Copy or reproduce Aestie.
• Reverse-engineer Aestie.
• Modify or create derivative versions of Aestie.
• Resell, redistribute, or commercially exploit Aestie itself.
• Remove proprietary notices or branding.
• Attempt to extract or reproduce our proprietary technology.

10Copyright complaints

If you believe content used or created through Aestie infringes your copyright, contact us at: support@aestie.app

Please include:

• Your name and contact information
• Identification of the copyrighted work
• Identification of the allegedly infringing content
• A statement explaining why you believe the use is unauthorized
• A good-faith statement that the information you provide is accurate
• Confirmation that you are the copyright owner or authorized to act on the owner’s behalf

We may remove content, disable features, or terminate access for repeat infringement or other violations.

11Disclaimers

Aestie uses automated and artificial-intelligence-based technology. AI-generated results can be unpredictable, inaccurate, or different from what you expected.

Aestie does not guarantee that:

• A generated image will exactly match your reference photo.
• A result will always be accurate or aesthetically pleasing.
• A particular filter or effect will produce the same result on every photo.
• Aestie will always be available or error-free.
• Generated content will be legally protectable by copyright.
• Generated content will be free of third-party rights.

You use Aestie at your own risk.

Aestie is provided “as is” and “as available,” without warranties of any kind, express or implied, to the maximum extent permitted by law.

12Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of Aestie.

Our total liability for any claim relating to Aestie will not exceed the greater of:

• The amount you paid to us for Aestie during the 12 months before the event giving rise to the claim; or
• $100 USD

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.

Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud or other liability that applicable law does not permit us to exclude.

Nothing in these Terms limits your mandatory consumer rights.

13Termination

• You may stop using Aestie at any time.
• You may cancel an Apple subscription through your Apple account settings.

We may suspend or terminate your access to Aestie if:

• You violate these Terms.
• Your use creates a security or legal risk.
• Your use harms other users or our services.
• We are required to do so by law.
• We discontinue the service.

Termination does not affect rights or obligations that arose before termination.

14Governing law; disputes

These Terms are governed by the laws applicable to [the jurisdiction in which Aestie is legally established], except where mandatory consumer-protection laws provide otherwise.

Any dispute will be handled by the courts with appropriate jurisdiction, subject to your mandatory consumer rights and applicable local law.

Nothing in these Terms prevents consumers from exercising mandatory rights available to them under the laws of their country or place of residence.

15Export & sanctions

• You agree to comply with applicable export-control and sanctions laws.
• You may not use Aestie in violation of applicable sanctions, export restrictions, or other laws governing the use of technology and digital services.

16Changes to these Terms

We may update these Terms from time to time as Aestie evolves.

If we make material changes, we will update the “Last updated” date and provide additional notice where required.

Your continued use of Aestie after updated Terms become effective means you accept the updated Terms.
